How Online Dispute Resolution Works
In 2020, our world was turned upside down by a global pandemic. Now, in the last half of 2021, we are unfortunately still seeing surges of COVID-19. Due to the ongoing crisis, the legal system continues to adapt as quickly as possible to the new realities we are all facing. While the court system has been significantly hindered across the country due to social distancing and closures, the legal community has forged a way forward through online services.
What is online dispute resolution?
Online dispute resolution is made up of what is known as alternative dispute resolution (ADR) tools, like mediation and arbitration. These alternative methods are allowing the legal system to carry on and the backlogged courts a much-needed relief. Traditionally mediators held face-to-face proceedings to assist parties in resolving disputes. But with closures and stay at home orders still frequent, the mediation field has quickly adapted with online proceedings. These online dispute resolution (ODR) tools allow parties to negotiate remotely and continue to resolve outstanding legal issues even if their hearings and trials have been cancelled or postponed. Likewise, if you are involved in a situation that is potentially suitable for mediation, you might be able to carry out the mediation virtually.
What is the video mediation process?
Videoconferencing platforms are providing conference space to conduct mediations, and more, nationwide. The process is straightforward in that all parties will receive access instructions ahead of the conference and often your mediator, or lawyer, will connect with you ahead of time to ensure you are able to access the system and understand the process. Just as in face-to-face mediation, the video platform allows for a shared room and side rooms for breakout sessions.
